CheckDulu is a digital screening platform developed and operated by IGO Smart PLT (“IGO SMART”). By accessing or using CheckDulu or any Services provided by IGO SMART, you acknowledge and agree that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”), Privacy Policy and applicable terms and conditions, policies and disclaimers located at or referenced at CheckDulu or specified in the sign up or registration form. You warrant that you are that you are at least eighteen (18) years old and are legally entitled to accept and agree to these Terms and are authorized and permitted to (whether on your own behalf or on behalf of the entity, business or company you represent – “Organisation”. If you do not accept these Terms or do not have authority to bind your Organisation, please immediately cease any further use of CheckDulu and the Services.
IGO SMART reserves the right to amend, vary, or update these Terms at its sole discretion at any time. Notifications of such changes may be communicated through the IGO SMART website, email, or any other communication methods deemed appropriate. Unless specified otherwise, such amendments shall take effect immediately upon publication. It is your responsibility to review these Terms periodically. Any use of CheckDulu after such changes constitutes your (and Organisation’s, if applicable) acceptance of the revised Terms.

You agree to use the CheckDulu service solely for lawful and authorized purposes. Your use of the Service is conditional upon your compliance with these Terms and all applicable laws and regulations. You are responsible for ensuring that all data you provide is and continues to be accurate, complete, and up-to-date. Please note that if You do not provide the requested or correct and updated information and/or documentation, you may not be able to access to the Service or this may affect the Service.
Certain features of the Service may require additional registration or incur fees. You must provide all necessary hardware, software, and internet access to use the Service. IGO SMART may, without prior notice, introduce new features or modify, suspend, or discontinue any aspect of the Service. All enhancements shall be subject to these Terms.
You are solely responsible for all aspects of your relationship with the individuals or entities you are screening (‘Screening Subjects’). This includes, but is not limited to, obtaining all necessary consents and authorizations required by law to conduct the screening and to provide their personal data to IGO SMART. You warrant that your collection and use of data related to Screening Subjects will at all times comply with all applicable privacy and data protection laws and regulations.
3.0 INTELLECTUAL PROPERTY AND CONTENT USAGE
All intellectual property rights, including trademarks, copyrights, trade names, logos, and proprietary data made available through CheckDulu (including all Content and reports), belong exclusively to IGO SMART or its licensors. You may view and use CheckDulu and the Content for personal or internal business use only.

You agree not to use the Platform or Service in any way which may be abusive, defamatory, obscene, offensive, indecent, seditious, inappropriate, objectionable or unacceptable as we may determine or which in any way breaches applicable laws or which may interfere with or disrupt their proper functioning or Our systems or networks.
When submitting or providing any information, materials, documentation or other postings or communication (collectively, “User Content”), you represent and warrant that you have all right, title and interest to the User Content, including but not limited to any consent and authorization from any third party or entity necessary for you to provide or upload the User Content. You confirm that all the User Content you provide is true, accurate, complete, updated and comply with these Terms of Use, Privacy Policy and the Personal Data Protection Act 2010 (and applicable regulations), We are free to use, modify, distribute and display in any form or media on a worldwide basis, such User Content without any obligation to You.
We may, both manually and automatically, derive and compile anonymized and aggregated data related to the performance, operation, and use of the Services (‘Statistical Information’). IGO SMART owns all rights to this Statistical Information and may use it for our business purposes, including research, development, and sharing with relevant parties.

4.0 WARRANTIES, LIMITATION OF LIABILITY AND INDEMNITY
You expressly agree that your use of the Platform and/or Service (including any use or reliance on any Content and information, materials or service available through the Platform and/or Service) is at your sole risk. The Platform and Service are provided on an “AS IS” and “AS AVAILABLE” basis. All data and services are provided as is, without any warranty or guarantee of any kind. We and the data owners expressly disclaim all warranties, whether express or implied, including but not limited to any representations, warranties andobligations in relation to the data or Service accuracy, timeliness, availability, reliability, fitness for a particular purpose or non-infringement. We do not warrant that the Platform or any third party website or resource is free from viruses other harmful or malicious code. We do not approve or endorse and are not responsible for any material or information provided by third parties on or through the Platform. You are solely responsible for all decisions and actions that may be taken arising or in connection with any Content, reports, information or materials available through the Platform or Service.
We are not responsible for:Interruptions or limitations to the service caused by User(s) or third-party system capacity issues, maintenance, updates, suspected fraud, abuse, viruses, or other misuse of the internet network.

Use of the service and any data is at your own risk. No responsibility is assumed for errors, delays, deletions, or data delivery failures under any circumstances. While we have in place reasonable administrative and technical safeguards that are designed to prevent unauthorized use, access, loss and destruction of the Platform or data, we do not warrant that the security and integrity of the Platform or such data will not be compromised.
To the fullest extent permitted under applicable law, IGO SMART will not be liable for any loss of profits, revenue or business or any indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of goodwill, use, data or other damages and losses whatsoever arising out of or related to use of the Platform or the Service. IGO SMART’s maximum total liability for any and all liability, damages, losses, costs, expenses, fees, penalties and claims whatsoever (collectively referred to as “Liability”) in connection with the Platform and/or Service shall be limited to the amount paid for the particular request for the Service giving rise to such Liability,
You agree to indemnify, defend and hold harmless IGO SMART, its officers, directors, employees, agents, representatives, subsidiaries, affiliates, licensors and partners from and against any claim, actions, demands, liabilities, costs, expenses and settlements, including without limitation reasonable legal fees (collectively, “Claims”), arising from, or alleged to arise from (i) your use of the Platform or Services; (ii) any User Content or any information or material you provide to Us or the Platform; or (iii) any breach of these Terms or Use.
5.0 FEES, CHARGES, AND PAYMENT TERMS
You agree to pay all applicable fees as stated on the CheckDulu or IGO SMART or it’s Partners’ platform for the Services rendered. All fees are subject to applicable taxes including SST or any other taxes imposed by law. IGO SMART reserves the right to reject or cancel any transaction if the information provided is inaccurate, outdated, or incomplete. Payment transactions may be affected by network or technical issues beyond IGO SMART’s control. IGO SMART shall not be liable for any transaction failures, delays, or errors caused by such events.
The fees charged are in exchange for the convenience and value-added service provided by IGO SMART. While the data originates from publicly available sources, IGO SMART streamlines the process by d presenting the information in a user-friendly and easy-to-read report format., The fees are for this facilitation and convenience.
6.0 SUSPENSION AND TERMINATION
IGO SMART reserves the right to suspend or decline your continuation access to the Service with immediate effect in the following circumstances:
IGO SMART will endeavour to provide notice where feasible but is not obligated to do so in cases of emergency or breach. Termination does not relieve you from liability for amounts due or breaches incurred before the date of termination. Following termination, You will not have further access to your Account or the Platform or Services and all your Account information may be deleted from the Platform in line with our operating policies. Upon termination of these Terms, Sections 3,4 and 8 of these Terms and any other provisions of these Terms that are intended to continue in force after termination shall continue in force.
7.0 GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
8.0 GENERAL
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and IGO SMART in respect of your use of the Service and supersede all prior understandings, communications, and agreements. Failure by IGO SMART to enforce any right or provision shall not constitute a waiver of such right or provision.
We do not warrant that the materials on the Platform or the Service are appropriate or available for use in all locations. Access to the Platform or the Service from territories where the materials, Content, Platform or Service are deemed unlawful or restricted is not allowed, and you do so at your own risk. International users of the Platform/Service agree to comply with all local laws governing their use of the same.
Notices to Us should be sent to the address stated at the Platform . We will send notices to You to the address submitted by You or which we reasonably determine is the appropriate address for You. Each agrees that e-mail, registered post and courier are appropriate methods of communication and notices communicated in this manner will constitute sufficient notice for the purposes of this Terms of Use. Notices sent by email are deemed received at the time when the notices are sent (provided that no non-delivery or failure message is received) and notices sent by registered post or courier are deemed received two (2) days after they are sent.
